'Judicial Activism Should Not Turn Into Judicial Terrorism': Former CJI B.R. Gavai

Former Chief Justice of India B.R. Gavai, in a candid interview, cautioned against excessive judicial intervention, stressing that “judicial activism should not turn into judicial terrorism.” He reaffirmed that the Constitution clearly defines the separation of powers between the legislature, executive and judiciary, and any overreach risks disturbing this balance. At the same time, he defended the role of Public Interest Litigation, noting that many citizens—due to socio-economic limitations—cannot directly approach courts to protect their rights. Allowing others to file petitions on their behalf, he said, helps fulfil the nation’s commitment to social and economic justice. However, Gavai emphasised that while judicial activism is sometimes necessary, it must always operate within constitutional limits to preserve institutional harmony.
